Terms of Sale
These Terms of Sale apply to furniture and related services supplied by Wolffmark in New Zealand.

Wolffmark is a New Zealand furniture business based in Tauranga and sells in trade.
Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including applicable rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.
1. Prices
All prices shown by Wolffmark are in New Zealand dollars.
All prices displayed on the consumer-facing Wolffmark website include GST if GST applies to the sale.
Delivery is additional unless a product page, quotation or order confirmation expressly says it is included.
For commissioned work, the final price may depend on the material, dimensions, resin treatment, base, finish, design requirements and delivery.
2. Available pieces
Wolffmark furniture is made individually. A completed piece may be the only one of its kind.
Submitting an enquiry or purchase request does not by itself reserve a piece.
An order is confirmed when Wolffmark has accepted the order in writing and any payment required to confirm the order has been received.
If a piece is no longer available before an order is confirmed, Wolffmark will tell you.
If Wolffmark accepts payment for a piece it cannot supply, Wolffmark will refund that payment.
3. Product information
Wolffmark takes reasonable care to describe and photograph each piece accurately.
Because furniture is made from natural materials, colour and surface appearance can vary with lighting, display settings and the individual material.
Dimensions are stated as accurately as reasonably possible. Small tolerances may occur in individually made furniture, particularly where natural edges or irregular timber form part of the finished dimensions.
If a specific dimension, colour, feature or use is essential to your purchase, tell Wolffmark before the order is confirmed so it can be checked.
4. Natural materials and finished appearance
Timber is a natural material and no two pieces are identical.
Variation in grain, colour, figure, knots, natural edges, historical markings, texture, density, hardness and other natural characteristics is expected.
Timber may undergo minor movement, checking or colour change as humidity, temperature and light conditions change.
Resin may also show normal surface wear and may gradually change in gloss or colour with use, age and ultraviolet exposure.
Visible natural characteristics and deliberately retained features shown in the completed furniture form part of the individual finished piece.
These terms do not treat a genuine defect as a natural characteristic. Nothing in this section limits a customer's rights where furniture does not match its description, is not of acceptable quality or otherwise fails to meet a guarantee required by law.
5. Completed pieces
Completed furniture is sold in the condition and configuration described on the relevant product page and order confirmation.
Customers should review the photographs, dimensions and description before purchase.
A private viewing in Tauranga can be arranged by appointment where practical.
6. Commissions
Commissioned furniture is individually made for the customer from selected material.
Before production begins, Wolffmark will confirm the principal agreed elements of the commission. Depending on the piece, these may include:
- approximate dimensions
- timber
- resin treatment where applicable
- base or support structure
- finish
- price
- expected timing
Unless otherwise agreed in writing, a 50% deposit is required to confirm a commission and begin work. The remaining balance is due before delivery or collection.
Natural timber cannot be made identical to a rendering, sample, photograph or another piece. Grain, edges, marks, colour and other natural characteristics of the allocated material will influence the finished result.
Changes requested by the customer after work has begun may affect the price and completion timing. Wolffmark will discuss any material change before proceeding with additional work where reasonably practical.
7. Cancellation of commissions
A commissioned piece is made specifically for the customer and Wolffmark does not offer a general change-of-mind cancellation right once work has begun.
If a customer asks to cancel a commission, Wolffmark will assess the stage of the work and the reasonable losses and costs already incurred or committed.
Wolffmark may retain from amounts already paid, or recover, reasonable costs and losses resulting from the cancellation, including specially allocated materials, third-party costs and work already completed.
Any balance not reasonably required to cover those amounts will be returned.
This clause does not limit rights or remedies available where Wolffmark has breached the agreement or where applicable law provides otherwise.
8. Payment
Wolffmark will provide payment instructions when an order or commission is confirmed.
Unless otherwise agreed in writing:
- completed furniture must be paid for in full before dispatch or collection
- commissioned furniture requires a 50% deposit, with the balance due before dispatch or collection
- delivery charges must be paid before delivery where they have been quoted separately
Title to the furniture remains with Wolffmark until the amounts due for the furniture have been paid in full, to the extent permitted by law.
9. Delivery
Wolffmark can arrange delivery throughout New Zealand.
Delivery charges are quoted individually unless expressly included in the purchase price.
The customer must provide accurate information reasonably needed to arrange delivery, including the delivery address and known access constraints.
Please tell Wolffmark about stairs, lifts, narrow entrances, steep or restricted driveways, difficult parking or other conditions that could materially affect delivery.
If incomplete or inaccurate access information causes additional carrier, handling or redelivery costs, Wolffmark may charge the reasonable additional cost to the customer where it is fair and lawful to do so.
Expected delivery timing will be agreed once the order is confirmed and the carrier has been booked. Timing may depend on destination, carrier availability, access and the requirements of the individual piece. If no specific delivery time has been agreed, delivery will be made within a reasonable time.
Where Wolffmark arranges delivery, Wolffmark remains responsible for its delivery obligations to the customer under applicable consumer law.
Customers should inspect the piece as soon as reasonably practical following delivery and contact Wolffmark promptly about apparent transit damage or another delivery issue. A request for prompt notification does not remove or reduce any statutory right.
10. Collection and customer-arranged transport
Collection from Tauranga may be arranged in advance.
If the customer engages a carrier independently, Wolffmark and the customer should agree the collection and handover arrangements before the furniture leaves Wolffmark.
Responsibility for loss or damage after handover to a carrier engaged independently by the customer will depend on the circumstances and applicable law.
Nothing in these terms excludes liability that cannot lawfully be excluded.
11. Change of mind
Wolffmark does not generally offer a refund, return or exchange because a customer changes their mind after purchasing a completed piece.
This does not affect any right to a remedy where goods fail to comply with the Consumer Guarantees Act 1993, do not match their description, or where another legal right applies.
Commission cancellations are dealt with under the commission cancellation section above.
12. Warranty and care
Wolffmark's current written Warranty & Care terms apply to eligible Wolffmark furniture.
The written warranty presently provides:
- 10 years for covered structural failures of steel bases and Wolffmark structural connections
- 5 years for covered timber joinery and resin workmanship failures

The written warranty is additional to statutory consumer rights. Expiry of the written warranty does not by itself determine whether a customer has a right or remedy under the Consumer Guarantees Act 1993.
13. Problems and repairs
If you believe there is a problem with a Wolffmark piece, contact Wolffmark and provide reasonable information about the issue.
Wolffmark may investigate the issue before deciding the cause and appropriate response.
Where reasonably practical, contact Wolffmark before arranging a third-party repair. This helps preserve evidence and gives Wolffmark an opportunity to inspect and remedy an issue for which it may be responsible.
This does not prevent a customer from exercising rights available under applicable law.
14. Website and pricing errors
Wolffmark takes reasonable care to keep product, price and availability information accurate.
If an obvious error is identified before an order is accepted, Wolffmark may correct the information and give the customer the choice to proceed on the corrected basis or not proceed.
If Wolffmark has accepted payment but cannot lawfully or practically supply the agreed piece, Wolffmark will provide an appropriate remedy, including a refund where required.
Nothing in this section permits misleading pricing or limits rights under the Fair Trading Act 1986.
15. Privacy
Personal information is handled in accordance with the Wolffmark Privacy Policy and applicable New Zealand privacy law.

17. Governing law
These Terms of Sale are governed by New Zealand law.
Any dispute will be dealt with under applicable New Zealand law and through the courts, tribunals or other dispute-resolution processes that have jurisdiction.
